| Boss comes to me while I'm washing my hands about to leave and said "see me in the morning, You were using your phone for 3 minutes before the bell went" and that was it. Bare in mind I think he doesn't like me, he moaned at me for being late once (first time in like 2 years) and another time for taking too long to start in the morning at 7:32 (we start at 7:30). 11 years for the company, not a single warning, not a sick day in 5 years, but I don't think these facts will mean anything to him. So yeah, what do you reckon? I'm thinking verbal warning but my mind is going crazy with worse case scenarios. | |

| I don't know your boss, so I can't comment on him personally, But I know you, and if he fires you (or even gives you a verbal) hes a tosser.
You are a young, reliable, hardworking and honest guy, it could be that he feels threatened by you, so by saying "see me in the morning" it's his own way of exercising his authority.

| I was let go from m job last week, put in on average 20 hours unpaid overtime every week, cam in on my days off, satyed late, helped out every other department. It means nothing to these people.
I think if he was gonna fire you, as you have a clean record, and this isn;t a sackable offence, he'd at least have to give you notice and pay you for a full pay period.
By the sound of it, I would say you're gonna get a ticking off, but keep your job.
Truth is, it could be a lot worse, and there are other jobs out there mate. Relax, and if he does let you go, don't dwell on it, put it down to experience, and get your ass down the job centre. There's work out there for those that are looking. | |

They might do this with him, but the truth is I hated my job and didn't fight to keep it.

| 1) Are you contracted? If so there is a shit load of bureaucracy that goes with firing someone e.g. notice periods, etc, etc 2) As Mithy says, if you haven't received any verbal/written warnings before they can't fire you for what can only be interpreted as a minor offence
End of the day bud, if they fire you, you take them to court. The government guidelines state that unfair dismissal is basically "your employer not having a fair reason for dismissing you i.e. there was nothing wrong with your job performance". Sounds like a cunt on a power trip so I wouldn't worry. Though i'd still be tempted to tell him to fuck himself. If he goes off on one and threatens you in any way i'd still have a word with your union rep (assuming you have one) on the sly to find out if he has adherred to company policy with regards to discplinaries. But it sounds like it should just be a talking to. I'd also sue Apple, iPhone's are addictive as fuck....if some fat fuckers can sue McDonalds's for making them fat then i'm sure you can have a crack at Apple. | |

| Bottom line is, he can't sack you full stop.
In fact, he's on a bit of a sticky wicket here - for such a minor infringement which could and should have been dealt with by a quiet, informal word on the spot, even a verbal warning is disproportionate. And quite deliberately leaving you to worry about things overnight could be quite easily viewed as psychological bullying.
As I said last night - if a verbal is given, very calmly tell him that you think the disciplinary action is disproportionate and therefore unfair, particularly in view of your exemplary record - let him know that informing you the night before and leaving you to worry overnight is unnacceptable and unprofessional - INSIST upon a full and detailed written notification of the verbal warning for your records (he has to do this anyway strangely enough). This SHOULD be enough to send a shot across his bow and let him know he needs to watch his step.
The guy sounds like a proper festering knob sore if you ask me and I'm sure it's all a storm in a tea cup - but do remember that as an employee you do have the right to be treated fairly and with a degree of common respect | |

| thats shit, I am sure that they cant do that. Get a copy of the staff handbook (or whatever they have there stating all of their policies) and see what is classified as an offence to get a written warning. I am sure that unless you have already been given a verbal warning,they cannot do this. also, ask how long it will stay on your employment record for too!! | |

| If he's never had a verbal warning before and been officially notified of that fact, then they cannot issue a written warning. It should state all the company's disciplinary procedures in your contract of employment and/or your written statement of terms and conditions of employment. It is a requirement of the law that each employee be issued with these documents upon employment. (Employment Consolidation & Protection Act??)
For such a petty infringment, as I said, even a verbal warning is disproportionate. But a written warning is so over the top that Dale may very well have a case for suing for constructive dismissal. OK, he hasn't been dismissed but that doesn't matter - if it can be shown that an employer is deliberately creating the circumstances for a future dismissal (thereby saving himself a few quid in redundancy pay) then he is guilty of constructive dismissal.
Sounds to me like this guy is looking to lay people off and wants to do it in such a way as to save himself money.
Consult a lawyer now - don't wait to see what happens next or let it disappear under the carpet - get some qualified legal help now.
