I have been with 3 now for the past 4 years or maybe even longer. I renewed my contract with them in November on the mix and match 300 tarrif which worked out at 15 quid a month. WELLLLLLL, it turns out that I have been paying a further £12 a month which is a video calling package.. WELL, i dont and never will use video calling so i called them up in August and told them to take it off. I was then told that it is part of my contract because i got an N95 (which broke and they wouldn't fix even tho it was less than 8 months old!!) I informed them that I was not told this when agreeing to my contract so insisted on them providing evidence that i had been told. They said that the evidence they have is in their notes. I demanded a copy of the telephone conversation from when I so called AGREED to pay £12 for something i would never use. They have since informed me that they do not have the call recorded and i will not get the £108 back that i have been paying and will have this charge on until the end of my contract in JUNE next year.

I am pissed off. really pissed off. I am 100% certain i did not agree to what they are saying I have, therefore they have broken all trading standards rules and regulations, but i have no evidence BUT nor do they.

I have refused to pay my bill since august and they have now got a debt collection agency onto me demanding that i pay, i have told them to refer it back to 3 mobile as the payment is in dispute, but they will not. BASTARDS

If i have to speak to another indian call centre i will lose my mind, I mean it takes them 10 minutes to inderstand what my fucking postcode is, let alone understand my complaint. it is like speaking to a fucking robot, i go on and on for 10 minutes and their response is "Yes Mr Graham, but you have an outstanding baance of £134, do you have a credit or debit card to cear the balance" Even the fucking supervisors are the same.. GRRRRRRRRRRRR. Any ideas on what I can do to sort this out.. I am at the end of my teather!!!!!

i hadnt only just realised i was paying an extra £12. I had internet and stuff which were all addons and i just assumed i had gone over the usage limit or the call/text limit, I never check my bills to be fair, but the issue iisnt when i realised it, it is the fact that they did it. They are bastards!

It is not the first time that I heard this type of thing from 3. I was warned not to use them for my contract, but when I chose my company - Orange - I was also told the same about them.

Mark, seriously......

The first thing you need to do right now is make sure you keep EVERY single piece of paper from the debt collection agency (they are subhuman scum who, if their was any justice, would be struck down with AIDS) and 3.

You seriously have to do this because they're relying on you NOT doing it. Write to the debt collection agency, sending the letter by recorded delivery, informing them that they should refer the matter back to 3 as the debt is in dispute between you and them. Tell them you have consulted your solicitor to act for you regarding the dispute with 3 and that until the matter is resolved with 3 you will regard them as an unconnected 3rd party, and therefore treat any further communications from them as harrassment. If the agency is actually a firm of bailliffs, ask them to forward you a copy of any County Court Judgement they have on the issue. They will probably refuse (cos they're arrogant pieces of shit and probably haven't got one) and try to bully you into paying with all kinds of threats - WITHOUT A COURT ORDER THEY CAN'T DO JACK SHIT TO YOU.

Call 3 and ask them for ALL paperwork and notes relating to your account - just make them make their case to you. They probably will refuse and in this case tell them that you are willing to pay the amount ONLY if they prove that you agreed to it. Tell them that if they fail to do this the matter is closed and any further communication from them on the subject, or any termination or interruption of your service resulting from this matter will be referred to Ofcom and your solicitor. Back this up in writing to 3's head office and also try to speak to someone there. Might also be a good idea to get in touch with Ofcom anyway, to ask THEIR advice.

The best advice I can offer is that you bin your 3 phone, stop paying their bills and tell them to fuck themselves. If it comes to a County Court, just write to them explaining that you have had no joy in disputing the debt with 3 because you cannot get to speak to anyone about it, and you are in dispute of the debt because you feel the contract was misrepresented to you.

And in future Mark, DON'T DO ANY BUSINESS WITH ANY COMPANY WHOSE CUSTOMER SERVICE IS BASED IN A FOREIGN COUNTRY - THEIR SERVICE IS ALWAYS SHIT AND THEY DON'T GIVE A FUCK ABOUT IT.
